1. Agreement to Terms

By accessing and using the website oldvillagegym.com (the “Site”) and the services provided by Old Village Gym (“we,” “us,” “our,” or “Company”), you agree to be bound by these Terms of Service (“Agreement”). If you disagree with any part of these terms, you may not use our Site or services.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on the Site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to decompile or reverse engineer any software contained on the Site
  • Remove any copyright or other proprietary notations from the materials

In no event shall Old Village Gym or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Site or materials, even if Old Village Gym or an authorized representative has been notified orally or in writing of the possibility of such damage.

5. Accuracy of Materials

The materials appearing on the Site could include technical, typographical, or photographic errors. Old Village Gym does not warrant that any of the materials on the Site are accurate, complete, or current. Old Village Gym may make changes to the materials contained on the Site at any time without notice.

6. Membership and Billing

If you purchase a membership or services through the Site:

  • You represent that you are at least 18 years old and have the legal capacity to enter into this agreement
  • You agree to provide accurate, current, and complete billing information
  • You authorize us to charge your payment method for membership fees and any other charges incurred
  • Membership fees are non-refundable except as required by law
  • We may cancel or suspend your membership if payment fails or if you violate these terms
  • Cancellation requests must be submitted in writing to admin@oldvillagegym.com

7. Assumption of Risk – Health and Safety

PARTICIPATION IN FITNESS ACTIVITIES INVOLVES INHERENT RISKS. You assume all risks associated with using gym facilities and equipment, participating in fitness activities, and using our services. You acknowledge that:

  • You are in good physical health and have consulted with a physician before beginning any fitness program
  • You have disclosed all medical conditions, medications, and health concerns to our staff
  • You understand the risks associated with physical exercise
  • You will follow all posted safety rules and instructions from staff

8. Waiver of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, AND DISCHARGE OLD VILLAGE GYM, ITS OWNERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES FROM ANY AND ALL CLAIMS, ACTIONS, OR SUITS ARISING OUT OF OR RESULTING FROM YOUR USE OF THE SITE, SERVICES, OR GYM FACILITIES, INCLUDING BUT NOT LIMITED TO INJURIES, DEATH, OR PROPERTY DAMAGE, REGARDLESS OF WHETHER SUCH INJURY OR DAMAGE IS CAUSED BY NEGLIGENCE, BREACH OF WARRANTY, OR ANY OTHER CAUSE.

9. User Conduct

You agree not to:

  • Harass, abuse, or threaten other members or staff
  • Violate any applicable laws or regulations
  • Engage in illegal activities
  • Upload or transmit viruses or other malicious code
  • Use the Site for spam, phishing, or fraudulent activities
  • Infringe on any intellectual property rights
  • Engage in any conduct that disrupts the normal operation of the gym or Site

10. Intellectual Property Rights

All content on the Site, including text, graphics, logos, images, and software, is the property of Old Village Gym or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or transmit any content without our prior written consent.

11. Limitation on Liability

IN NO EVENT SHALL OLD VILLAGE GYM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

These Terms of Service, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Old Village Gym regarding your use of the Site and services and supersede all prior agreements and understandings.

18. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
